In 2021 we hired CMT Engineering to perform special inspections on the construction of a masonry retaining wall. Quoting their own website "It is the inspectors job to make sure the project is constructed to plans and conditions". We paid CMT engineering thousands of dollars for numerous site visits, with written reports claiming work was done correctly. In October 2023 CMT Engineering provided a Certificate of Special Inspection with the engineers signature and official stamp both taking responsibility for performing the special inspections, and also certifying that the wall was built in compliance with building code and permitted plans. Less than 9 months later the wall failed (See Photos), we sent the structural engineer to the site to see what happened. In his report was documentation that the wall was built nowhere close to the plans. Missing blatant details (height of wall, improper rebar, no tension breaking joints, no weep holes, etc) clear to the naked eye of any reasonable inspector. Since we had paid CMT Engineering a hefty sum for the special inspections which obviously didn't happen we reached out to them hoping, since they did not perform the inspections we paid for, they would take responsibility for rebuilding the wall. Unfortunately we were met with and Engineer that told us inspecting the wall wasn't in their "scope of retention" (it was the only thing they were hired for). We went up the ladder to regional manager DJ Peters who essentially told us they were not going to take responsibility for the failure and to talk to their attorney. We have since filed a complaint with the AZ Technical Board of Registration. Now after spending 3 months demo-ing and rebuilding the wall again (with special inspectors that actually did their job) to the tune of over $80,000, we are faced with hiring an attorney and filing a lawsuit just to force CMT Engineering to take responsibility for their failure. In short, this company has zero ethics! An engineer that took payment for special inspection he didn't perform and a regional manager that is knowingly doing the wrong thing. We have retained an attorney and will start the process the hard way.
