Dale took my $4,500 for a final patent application and its the worst decision I have ever made. First off lets make sure to be clear. I reached out to Dale as I had already filed with another lawyer and as I have never filed a patent before have little experience with patent lawyers. Unfortunately I wish I had picked anyone else but Dale.

Our agreement was $4,500 for him to file my final patent application. It included the patent drawings as the ones I already paid for where not good enough. This was done and submitted. It did take a long time to hear back but to my surprise Dale waited a whole month before he let me know that I got a response after almost 2 years of waiting. Keep in mind I had not gotten any updates or suggestions to say pay him a $2,000 retainer.

The examiner sent back the application because of the way it was worded it would not be possible and even though Dale says he did it correctly here we are. The other thing that I found strange was that the drawings I paid for from Dale where also rejected. They where not allowed to be hand written numbers and arrows. Now that was strange to me as I paid for professional drawings not hand written ones and even though I missed this I would expect a seasoned patent attorney to know what would be accepted and what would not.

Now he then say that in order to respond I need to pay his $2,000 upfront retainer. Funny thing that was never discussed at any point in any email or phone call. Yes are agreement said I would be responsible for future issues but make sure your ready to drop another $2,000 just to fix the artwork that was done incorrectly in the first place. Not to mention that he took a month of the 3 months I had to even let me know. Now I had only 2 months left to figure it all out and try to find someone else to fix his mistakes.

I would not suggest him as your patent attorney unless your ready to pay more than he says. Do not trust his "upfront" pricing as its baked in with misleading "errors" that need to be fixed. His failure to let me know made it even more difficult to find someone. Now I am almost at the deadline with out any options and his sage advice was maybe I should not have applied for the patent in the first place. Yes taking care of my sick mom for the last 5 years was hard. Yes putting everything I had and borrowing from friends and family in order to complete this patent application was hard and yes maybe not the best decision I have made. He sure didn't mind taking my $4,500 in the first place with zero suggestions that maybe I would not be able to afford his services. Just a warning to others out there like me with a dream do not trust this man with it he will not help you.
